Joining a Buy-Cycle authorizes MobShop to charge your credit card for the current cycle price, shipping and tax. Additionally, by joining a Buy-Cycle, you are agreeing to the terms and conditions provided herein. Do not join a Buy-Cycle if you do not agree to abide by these terms and conditions. Orders are considered non-cancelable once submitted, but we reserve the right to cancel orders if the product is of limited availability or if we believe an order has been placed for the purpose of resale. MobShop is not responsible for unprocessed bids.

Payments

MobShop accepts VISA, MasterCard, American Express and Discover Card credit cards for payment. Charge totals are authorized based on the current cycle selling price or selected Save a Spot^SM tier, plus estimated shipping costs and applicable tax, if any. This authorization will be outstanding until the Buy-Cycle has closed, purchases have been shipped, and all estimated charges can be calculated. The resulting charge appearing on a customer invoice and billed to the credit card will never exceed the estimated charge at authorization, and because of our unique demand aggregation model, actual charges will often be much lower than the initial authorization amount.

Sales Tax

As required by law, sales tax will be charged on all customer orders shipped to states in which a particular supplier has a physical presence, unless the state does not charge sales tax. Since we work with multiple suppliers located in various states, sales tax may apply on certain orders. If you are a tax-exempt individual, we cannot override our system to remove the tax applied. Please work with your state and federal tax bureaus to receive a credit.

Shipping Policy

MobShop honors the carrier relationships and pricing of our supplier partners. From time to time, we will offer special shipping promotions for particular products or categories. If shipping is free, you will see the option for free promotional shipping during the checkout process. MobShop will not refund shipping costs due to customer oversight after a purchase is authorized. An additional insurance charge of 35 cents per $100 is added for all levels of shipping. Products of significant value mailed USPS will be shipped via certified mail. Upon completion of the Buy-Cycle, all purchases will be packaged and shipped from our supplier partners' warehouses.

Most products ship within three to five business days after your Buy-Cycle has closed. To calculate the approximate date of delivery, count three to five business days from the date your Buy-Cycle closes, PLUS the number of days in whichever shipping method is chosen (e.g., overnight, 2nd day, 5-7 day, etc.). Once packing and shipping operations are complete, final billing will occur. We will send you shipping notification, including the final price of the good and the actual tax charges. At this time, we do not ship to locations outside of the United States. We also cannot ship to Post Office Boxes or APO addresses.

Backorder Policy

MobShop works with its suppliers to ensure that they have available stock for all products before they are featured on MobShop's site. However, sometimes unforeseen demand leads to backorder situations. If a product is on backorder, either the supplier or MobShop will notify the customer of the delayed shipment of their product. At that time, customers will have the option to cancel their order. We will work with other supplier channels to secure inventory to fulfill the order demand as soon as possible. If product is on indefinite backorder and we are unable to source the product from another supplier, then we will contact the customer and cancel the order.

Returns and Warranties

Returns and exchanges are handled directly through the supplier of your product, according to the terms and conditions of their individual policy. If you cannot determine the name of your supplier or have difficulty contacting them, contact MobShop Customer Support for assistance at (800) 733-5612 or service@mobshop.com.

Occasionally our partner suppliers ask MobShop to facilitate returns and exchanges on their behalf. In such cases, MobShop's name will appear under the supplier heading on your Customer Receipt and we will handle your return or exchange directly.

Please be aware that all returns handled through MobShop or our supplier partners must be accompanied by a valid Return Authorization Number clearly marked on the OUTSIDE of the return shipping container. Both MobShop and our supplier partners are unable to accept unauthorized returns. You can obtain a Return Authorization Number from the supplier of your product. In cases when we facilitate returns and exchanges on the supplier's behalf, you can obtain a Return Authorization Number from MobShop. Each product offered by MobShop is subject to the terms and conditions of that product's manufacturer's warranty. Please contact the manufacturer with questions regarding the product and/or its warranty. Extended warranties are sometimes offered directly through the manufacturer; please contact them if you are interested in purchasing an extended warranty. MobShop does not provide an additional warranty on products offered.

Order Cancellations

Because MobShop's dynamic pricing is based on the number of people who actually join a Buy-Cycle, customers cannot cancel their orders once they have committed to a purchase. However, after you have received an item it may be returned or exchanged in accordance with the policy set by the supplier.

Fraud

It is a violation of the law to join a Buy-Cycle in a false name or with an invalid or stolen credit card, even if we authorize the transaction. Be aware that even if you use a fictitious name or invalid account, your web browser transmits a unique address to us, which can be used by law enforcement officials to identify you. MobShop cooperates with law enforcement officials to prosecute fraud cases to the fullest extent of the law.

Promotions

General Promotion Policy
This General Promotion Policy, in conjunction with the specific terms and conditions of each individual promotion, apply to all MobShop promotions. If a conflict arises, the terms and conditions of the individual promotion control. Participation in a promotion and/or use of a promotion code is limited to one per customer. Each promotional offer expires on the date stated in the individual offer or when the maximum number of users is reached. If no date is stated, promotional offers expire sixty days from first transmittal of the promotional offer by MobShop. Each promotional offer applies toward the purchase of a single product only, does not include taxes, shipping or handling, and is not redeemable in combination with other offers or promotions. Dollar-off promotional offers are only valid for orders that exceed the dollar value of the offer. Any misuse or fraudulent use of any promotional offer will void the offer. Void where prohibited, taxed, or restricted by law. MobShop is not responsible or liable for altered, lost, illegible or incomplete submissions or for human, telephone, computer, online, or technical malfunctions or failures. If any promotional offer is compromised by a virus, bugs, non-authorized human intervention or other causes beyond the control of MobShop which corrupt or impair the administration, security, fairness or proper operation of the offer, MobShop reserves the right in its sole discretion to suspend or terminate the offer.
